South Sound Chamber of Commerce Legislative Coalition Legislative Report – February 16, 2024

 

We are now past the House of Origin cut off so bills that are remaining are those that will be considered alive for the session.  Unless of course something is determined “necessary to implement a budget” – then it might come back to life.

 

The next cut off dates is February 21 for bills to be out of the opposite house policy committee so you can see from the list below that there is a frantic effort to move bills out committees.  The “upcoming events” report below will give you a pretty good look at bills that are going to be considered and moved.  Executive Session means it will come up for a vote, but basically any bill that has had a hearing could be moved out of committee pretty quickly.

 

Monday, February 26th is the date for bills to be out of the opposite house fiscal committee.  After that date, it will be all floor session voting, conference committees, amendments, and long caucuses for the next 10 days until the Legislature adjourns Sine Die on March 7th.

 

The bills we seem moving that potentially have the most controversy include ESHB 1893, which would provide unemployment insurance to striking workers and ESHB 2114 which is the rent control bill.  ESHB 1893 was heard in Senator Labor & Commerce this week (thank you to everyone who signed in opposed).  ESHB 2114 will be heard next week in Ways and Means – click on the bill number below to sign in to oppose that bill in committee. ESHB 1589, the PSE natural gas bill, was also moved out of the Senate Energy, Environment and Technology Committee this morning.

 

Both House and Senate budgets will be out next week – along with commensurate hearings in the appropriate committees.  This will let us know if there is any assumption for the REET tax or property tax – or any of the other taxes.  We are also hearing rumors that some of the initiatives may still be in play for floor discussion.  We’ll see if that actually happens.

 

I’ve attached the Revenue Forecast released on 2/14 for those who are interested. 

 

Also, here is a link to housing bills moving from the perspective of the “Sightline Institute” and “Homes 4 Washington.”  I’m not sure we would have the same positions as these groups, but it is a pretty comprehensive look at the housing bills still in play.

HB 1893/SB 5777 (OPPOSE), Unemployment benefits for striking workers – The bills would have all employers subsidize unemployment benefits for striking workers, relieving or at least heavily reducing union obligations to fund strikes from their own war chests. The Employment Security Department has provided data showing a strike where workers earn $80,000 or more (think Boeing or Amazon) could cost as much as $500 million. That would be a huge hit to our $3.7 billion trust fund, as of the November report, likely triggering a tax increase on all employers in the state. The House moved HB 1893 by a 53-44 vote at 2 in the morning.  The bill has a Senate hearing on February 15th.  

 

 

SB 5897/HB 1894, Business licensing (SUPPORT) – Companion bills requested by the Department of Revenue could advance from their chamber of origin, but it appears the Senate version will most likely be sent to the governor’s desk. SB 5897 passed the senate Thursday, February 8. Meanwhile, HB 1894 was placed on second reading on Saturday, February 10th. The bills would increase the size of the reserve account used for programming and other updates to the online Business Licensing Service.

 

HB 2430, waiving fees (SUPPORT)- This bill waives handling and delinquency fees for businesses closed by government order due to a disaster or declared emergency and was placed on second reading on Saturday, February 10th. Supported by other small businesses, it only has a couple more days to be passed out of its house of origin or it is considered dead for session. 

 

SB 5778/HB 1940, Employer political speech (OPPOSE) – The Senate passed SB 5778 on Wednesday, February 7, on a nearly party-line vote.  The bill would prohibit employers from requiring workers to attend company meetings where management addresses unionization efforts, discusses new or proposed laws or regulations impacting the business, or where any political or religious matter is the meeting topic. Its companion, HB 1940, passed the House labor committee and was sent to Rules, where it is likely to remain.

 

SB 5793/HB 1991, Paid sick leave (NEUTRAL) – The senate narrowed the bill from “sick leave for snow days” to allowing sick leave to be used when a child’s school or care facility is closed due to a declared emergency. On February 7, the bill passed the senate, 28-21. The House has already scheduled the bill for a public hearing and executive action next week. The companion, HB 1991 is eligible for a floor vote in the House, but it is very likely that the bill will not move due to the passage of the senate version. 

 

HB 5924, Personnel records (OPPOSE) – This bill requires the employers to provide employees a copy of their personnel file within 21 days after the employee requests their file, at no cost. Additionally, the employer must furnish a written statement stating the effective date of discharge to a former employee, as well as the reasons. This bill was scheduled for executive action in Way and Means, but failed to moved, so it is considered dead for session.  

 

HB 2266/SB 6107, Sanitary conditions for construction workers who menstruate or express milk(OPPOSE UNTIL MODIFIED) – The bill requires employers would be required to provide hygiene products to workers, a private, lockable bathroom or lactation station, and chilled storage for breastmilk. HB 2266 passed the House with a vote of 84-13, 1 excused on Thursday, February 8th.  The senate companion, SB 6107 received a public hearing, but no further action, in the Senate Labor & Commerce Committee.
